Photographer's rights
One of my friends is an avid amateur photographer and I asked him this qn: 'Can he legally take pictures of people in public places?' Second, can he use those pictures in blogs/publications etc?
He said he doesn't know but plays safe by always asking for permission before taking a picture of someone. So legal eagles & spouses of legal eagles (you know who you are), can answer my qn?

Hi markfch,
Checked with someone I know and this is the reply as per dictated ....
"This is a tough one as the parametres have not really been tested in Singapore to its full extent possible.
As a rule of thumb, if it is a picture taken at a public place of the public in general, there does not seem to be any restriction imposed by the law as it stands.
However, if it is a picture taken of a private event, issues of permission etc... come into question.
So respect one's privacy. But if they decide to dig their nose in public, it's their folly"

Taking photos:
Should be okay as long as he is not invading anyone's privacy.
Publishing Photos:
if the people he took picture of have recognizable faces he will need a model release. Did a search on Wikipedia and here is some info on that
"Publishing an identifiable photo of a person without a model release signed by that person can result in civil liability for whoever publishes the photograph."
http://en.wikipedia.org/wiki/Model_release
Only exception is if images is shoot for news i.e. photo journalism.
disclaimer : me not a lawyer.

Gross but ......verykiasu2010 wrote:please don't do thatmarkfch wrote:Right. Must avoid doing any embarrassing things (like digging nose?) in public . Wonder if I got snapped doing that, can I go request that the photographer delete the picture or not?
you should demand for royalty payment instead
I will usually seek permission before I snap away, esp if they are going to appear in the pictures that I am taking. For example, I am with my girl, waiting for the class to start and she is with her classmates and their parents are there too, I will even check with the parents first if I could take pictures of them with my child.

I have been wondering why taking of bus pictures ain't allowed in interchanges, I've been a bus enthusiast for years, and it's not the first time that I've been stopped by SMRT officers for taking pics in the interchanges...
Anyway, I visit STOMP too, and they need a more stringent moderation team. Pictures of people, faces censored or uncensored, appear there, as the main focus, daily. I've seen n[/n] STOMPs of people sitting on the priority seats just because he/she did not give way to some old lady, I DON'T CARE HOW MANY OLD LADIES are there, priority seats are a privilege, not a right, imagine, how embarrassed those people must feel, with their pictures on the web for 6.5 billion other people to see?
This is also why I never sit on the MRT... Haiz...

Last week when I was in ikea tampines with my colleagues for lunch, there were these 2 ladies, an old lady with a slight hunch and a middle age one. The younger one just sat at the table and the elderly one went to queue to order their meals.
I felt a bit irritated at the sight. Then my colleagues told me that we can't just see things from the surface. It could be that the old lady did not know what to order so she let the younger one reserve the table instead.
Imagine if I'm nasty and took a photo to post in Stomp complaining of lack of filial piety. That's why Stomp can be so crass sometimes.

This happened to me a last week. I had some stuff to carry - lap top, some books etc. and was coming home by MRT. I sat in the privelege seat as it was empty and no one seemed to need it. Couple of stations the train was full and a pregnant lady got in. I got my stuff together and was above to stand up but she refused politely, saying she doesnt like to sit . I sat back and the pregnant lady stood right in front of me, blissfully listening to her ipod. I spent the next 10 mins feeling very guilty in my seat. If i stood with thoses bags then i probably would be a hinderance .
And what would anyone have tot if they saw the scene? If i saw such a scene, i would have given the seated lady dirty looks :x
