IPad trademark dispute in China

"...Attorneys for Shenzhen Proview Technology and Apple went head-to-head on Wednesday during a heated hearing in Shanghai over the bitter iPad trademark dispute.
The first session was adjourned after four hours, during which Proview denied having sold the right to use the iPad trademark to Apple, while the US tech giant rejected calls for a sales ban on its tablet computers.

Experts say the disputes result from a fundamental difference in the systems used by various countries. In developed nations such as the United States and Britain the right to use a trademark is granted to the individual or company who first uses it.
However, in China, the right goes to the first person to file a patent application.

Liu at Renmin University added that at the root of the problem is the ideology of the planned economy.
"Some Chinese people are still after a free ride and haven't learned to respect the property of others, especially when it comes to intangible property like trademarks," he said..."

saw a news item (http://www.chinadaily.com.cn/cndy/2012- ... 672535.htm) that already chinese 'entrepreneurs' have trademarked Jeremy S.H.L. That person is making sports items using that trademark. Best of all, if the real Jeremy Lin wants to use that trademark in china, he will probably have to buy from her.

Seriously, this is crazy. how can pp get rights to occupy someone's name just becos it's an investment proposition? shouldnt' that individual in question agree to it first?

Whilst some try to make quick money out of famous brands/persons, you can't beat their quick thinking and kiasuism, can you? They do it before new laws have been enforced - whilst most of us would assume or consider if it is legal first and foremost. (Not saying there are any goods and bads). While the world debates over these questions, they're already making their money.

True, but to me this is a sign that the world has gone insane over the search for money. not good.

the fact is that Proview had the mark 'iPad' first, well before Apple dreamt of the product

their dispute is on the territorial rights maintained / continued to be claimed by Proview. Blame the lawyers of both sides did not do a good job. They should have used CSM !

the day Proview launched their case to get China Customs to block the export, Apple's market cap dropped by 2%.

saw on the news last night, some people had event trademarked "Facebook" and "FaceBooK" in China hoping for a windfall.
