My Filipino maid wants to take advance home leave. I know there's a standard Philippines employment contract to sign but I didn't expect this.

Is it safe to sign?
My maid was recruited by this agency but now I'm asked to sign a Direct Hire document and it discharges agency of any implication.

I know we can't direct hire Filipino cos Phil wants to control the citizens, said it is to protect them. Phil wants to appoint recognised maid agencies as legal human marketeers so with this doc, what does it mean to you, as an employer?

Don't sign anything, I think your agency is trying to pull you in some unknown trap.

How can it be direct hire, since you went through an agency ? Is this girl on tourist visa here ? As long as an Agency is involved, it is not called Direct hire anymore, if you go see Labour Officer in PHP Embasssy, this agency sure kena one.

So be careful

I agree with chix, don't sign anything at all!!!!

The document appears to be for your maid to sign, not for you to sign.

But I guess if she signs that, you might get into trouble too, maid employers are the most vulnerable.

Nowadays maid agencies are very smart, so try not to sign anything that you are not sure of..

If you go through an agency, why do you have to sign this form?
to apply for home leave, one of the key thing is the authentication of contract, which is usually a different contract that we signed with our helper. the agency should already help you to sort this thing out and you do not need to get involved in this. If the maid run to embassy and complain that she is not paid according to this contract, agency and employer can be sued. I suspect this agency try to absolve themselves from this potential situation, want to wash their hand off. If you have the all the doc required to apply for adv home leave(one of the key doc is authentication of contract which they will usu pass to you when you first hire the maid). just ask your maid to go embassy and apply for OEC. You do not need to go through agent and sign this unnecessary doc. Pls highlight the name of the agency so others will be warned.
